Clause 4.6 variations to development standards

Where a proposed development seeks to depart from a numerical development standard contained in Council's LEP (such as minimum lot size, maximum FSR or building height), a Clause 4.6 statement justifying the proposed departure from the development standard is required to be prepared and submitted with your Development Application to Council.

In justifying a departure from a development standard under this Clause, Council must be satisfied that compliance with the development standard is unreasonable and/or unnecessary in the circumstances of the case, having regard to the objective/s of the development standard.
